Die Ausweisung von Ausländern aus der Bundesrepublik Deutschland infolge strafrechtlicher Verurteilung stellt eine besonders schwerwiegende Maßnahme der Gefahrenabwehr im Aufenthaltsrecht dar, die auf Aufenthaltsbeendigung abzielt. Diese setzt mit dem Erfordernis einer Gefahr als Voraussetzung der Eingriffsmaßnahme eine Gefahrenprognose der Behörde voraus. In der Verwaltungspraxis ist die Prognose von Erfahrungserwägungen geprägt, kriminalprognostische Gutachten werden regelmäßig nicht eingeholt. Anders ist dies insbesondere im Strafvollstreckungsrecht. An strafvollstreckungsrechtliche Entscheidungen fühlen sich die Ausländerbehörden jedoch nicht gebunden. Die Arbeit untersucht, ob die Anforderungen an die Gefahrenprognose im Ausweisungsrecht ausreichend beachtet werden.
