In Indien war das Recht auf Eigentum aufgrund seiner Bedeutung für die zukünftige Wirtschaftsordnung des Landes eines der umstrittensten Grundrechte überhaupt, das 1950 Eingang in die neue Verfassung gefunden hat. 1978 wurden die Eigentumsartikel aus dem Grundrechtsteil gestrichen und in modifizierter Form an anderer Stelle in der Verfassung geregelt. Entgegen gandhianischer Eigentumsphilosophie wird das Recht auf Eigentum heute grundsätzlich als Menschenrecht anerkannt. Die Debatte um die Eigentumsartikel führte zur Klärung grundlegender Strukturen des indischen Verfassungsstaates. Neben der Reichweite des Eigentumsschutzes sind sein Verhältnis zu gegenläufigen Staatszielbestimmungen und die Grenzen der Verfassungsänderung weitere Themen der vergleichenden Betrachtung.
