Indem deutsche Banken im Ausland Tochtergesellschaften gegründet haben, sind Risiken für sie entstanden, die von der deutschen Bankenaufsicht bis zum Dritten Gesetz zur Änderung des KWG nahezu unbeaufsichtigt waren. Die vorliegende Untersuchung stellt diese Risiken zunächst dar. Im Anschluß hieran werden die rechtlichen Grundlagen der Bankenaufsicht erörtert. Die Lücken des bisherigen Rechts sowie die Möglichkeiten diese Lücken zu beseitigen werden aufgezeigt. Schließlich wird untersucht, ob es der KWG-Novelle gelungen ist, diese Lücken zu schließen.
