Pressefreiheit ist als Grundrecht in der indischen Verfassung verankert. Contempt of Court und Contempt of Parliament dienen dagegen als Abwehrrechte von Gerichten und Parlamenten und schränken damit die Pressefreiheit ein. Ziel der Arbeit ist es, das Spannungsverhältnis zwischen dem Grundrecht und seinen Schranken zu untersuchen. Im Vordergrund steht dabei ein Vergleich mit dem englischen Recht: Diente es bis zur indischen Unabhängigkeit im Jahr 1947 noch als Vorlage für das indische Recht, so haben sich beide Rechtsordnungen in den vergangenen 50 Jahren separat weiterentwickelt. Anhand von Präzedenzfällen wird diese Entwicklung nachgezeichnet und einer abschließenden Beurteilung unterzogen.
