Die Arbeit zeigt, daß letzlich sogar zwei Grundsätze zur Subsidiarität der Nichtleistungskondiktion im Drei-Personenverhältnis existieren. Während der erste historisch herzuleiten ist, läßt sich der zweite auf der Grundlage des geltenden Rechts systematisch begründen. Ein Vergleich mit den Rechtsordnungen Österreichs, Englands und Frankreichs bestätigt die nach deutschem Recht gefundenen Ergebnisse für die bereicherungsrechtliche Rückabwicklung von Drei-Personenverhältnissen.
