Der pacta-tertiis-Grundsatz, wonach Verträge für Dritte ohne ihre Zustimmung weder Rechte noch Pflichten begründen, gilt als einer der Grundpfeiler des Völkerrechts. Die Frage nach der Existenz etwaiger Ausnahmen wird jedoch oft nur oberflächlich und auf wenige Fallgruppen begrenzt gestellt. Andreas Witte geht neue Wege, indem er in Form von Fallstudien bislang weniger beachtete Konstellationen einer möglichen Drittwirkung von Verträgen untersucht. Zentrale Fragestellung ist, ob die dabei identifizierte Auswirkung eines Vertrags auf Nichtparteien eine schlichte Ausnahme von pacta tertiis darstellt, oder ob sie dogmatisch ohne das Postulieren einer solchen erklärt werden kann. Gelegentliche Seitenblicke in Form der - im Völkerrecht verbreiteten und nützlichen, jedoch nicht immer risikofreien - Zivilrechtsanalogie reichern dabei die Untersuchung an.
