Die seit dem 10. Januar 2015 geltende Brüssel Ia-VO setzt einen Meilenstein für die grenzüberschreitende Zwangsvollstreckung in der Europäischen Union. Bisher mussten Entscheidungen ein Zwischenverfahren, das sogenannte Exequaturverfahren oder auch Vollstreckbarerklärungsverfahren durchlaufen, bevor sie in einem anderem Mitgliedstaat vollstreckt werden konnten. Die Brüssel Ia-VO beseitigt das Exequaturverfahren. Bei der unmittelbar grenzüberschreitenden Vollstreckung fließen das Recht des Ursprungsstaates, das Recht des Vollstreckungsstaates und das Unionsrecht zusammen. Denise Wiedemann untersucht, welche dieser Rechtsordnungen Anwendung auf einzelne Fragen der Zwangsvollstreckung findet.
