Stefan Korte erörtert auf Basis eines ökonomischen Wettbewerbsmodells, ob es zwischenstaatliche Konkurrenz mit dem Mittel des Rechts gibt. Er kommt zu dem Ergebnis, dass sie nur als sogenannter Standortwettbewerb möglich ist. Diese Form zwischenstaatlicher Konkurrenz verlangt allerdings nach einer Wettbewerbsordnung im übergeordneten Recht, um funktionsfähig zu sein. Sie besteht aus fünf Geboten zwischenstaatlicher Konkurrenz. Misst man das Unionsrecht und das bundesdeutsche Verfassungsrecht daran, so zeigt sich, dass nur das Unionsrecht als Ordnung mitgliedstaatlicher Konkurrenz begriffen werden kann. Aus dieser Klassifikation können dann rechtliche Schlüsse im Sinne einer kompetitiven Interpretation der Verträge gezogen werden. Sie erklärt beispielsweise die grundsätzlich hohe Kontrolldichte des EuGH im Rahmen der Prüfung der Grundfreiheiten.
