Marcus Hahn-Lorber untersucht diese anhand des deutschen und schottischen Verfassungsrechts unter dem Oberbegriff ""Parallele Gesetzgebungskompetenzen"". Art. 72 Abs. 3, 84 Abs. 1 GG sehen erstmals im Grundgesetz parallele Kompetenzzuordnungen vor. Im Vereinigten Königreich (Scotland Act, Northern Ireland Act) ist diese Kompetenzform sogar Grundfall dezentraler Kompetenzen. Der Verfassungsvergleich reflektiert die neue Kompetenzform dogmatisch und theoretisch und berücksichtigt dabei die Ideen von Souveränität, Subsidiarität und der Europäischen Integration.
