Die Arbeit beschäftigt sich mit folgenden Problemen: Lassen sich die ""traditionellen"" Erlaubnistatbestände des Datenschutzes mit einem Risikoansatz verbinden? Ist das Datenschutzrecht in der Lage, die Freiwilligkeit der Zustimmung des Einzelnen zu gewährleisten? Die grundlegende Frage lautet, ob und wie die Idee der Selbstbestimmung im Rahmen eines informationsorientierten und gefährdungsabhängigen Datenschutzkonzepts beibehalten werden kann.
