Public Service Broadcasting and European Law

Edited by Bruno de Witte

| book description |

The text examines the impact of European law on the position and legal regime of public service broadcasting in the member states of the EU. Individual chapters deal with the general regulatory context provided by national media law and with specific dimensions of EC law, such as the role of the directive television without frontiers , the contemporary controversy about whether public funding of broadcasters should be considered as state aid and the convergence between media and telecommunications in the European Commission's regulatory approach. Through discussion of these particular topics, the book aims at drawing a global picture of the impact of European law on public service broadcasting. Despite the existence of a special Protocol to the Amsterdam Treaty which was intended to shield public broadcasting from the impact of EC law, it is shown that European Community law has had, and continues to have, a distinct influence on the way public service broadcasting is defined and regulated at the national level.
